Deathtide ACEmulator Server Terms of Service Agreement

Welcome to the Deathtide ACEmulator game server ("Server", "We", "Us", "Our"). We are an independent, non-commercial server emulator project. By accessing or using our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use our Service.
 
1. Description of Service
 
The Deathtide ACEmulator server is an open-source, non-commercial server emulator for the discontinued MMORPG Asheron's Call. The service is provided on an "as is" and "as available" basis, for non-commercial entertainment purposes only.
 
2. User Accounts
 
  • Account Information: You are responsible for providing accurate and complete information when creating your account.
  • Account Security: You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. Do not share, sell, or transfer your account to any other person.
  • Termination: We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that violates these Terms, is harmful to other users, or for any other reason at our sole discretion.
3. Acceptable Use & Prohibited Conduct
 
You agree not to engage in any activity that is harmful, illegal, or interferes with the fair and intended use of the Service. Prohibited activities include, but are not limited to:
 
  • Cheating & Exploitation: Using, developing, or distributing cheats, hacks, bots, or any unauthorized third-party software designed to modify the game experience or gain an unfair advantage.
  • Harassment: Engaging in any form of harassment, hate speech, bullying, doxing (publishing private information), or other disruptive behavior.
  • Unauthorized Access: Attempting to gain unauthorized access to our servers, other users' accounts, or related systems and networks.
  • Intellectual Property Infringement: Posting or sharing content that infringes upon the intellectual property rights (copyrights, trademarks, etc.) of others, including those of the original game creators (WB Games Inc., Turbine, Inc.).
  • Commercial Activity: Using the Service for any commercial purposes, including selling in-game items, accounts, or services for real-world currency.
4. Intellectual Property
 
All rights, title, and interest in and to the original game Asheron's Call, including without limitation, any game code, themes, objects, characters, names, stories, artwork, and music, are owned by the original creators or their licensors.
 
The ACEmulator project is an independent, open-source effort and claims no ownership of the original intellectual property. We grant you a personal, non-transferable, and non-exclusive license to use our server software for your non-commercial use, subject to these Terms. You may not reverse-engineer, decompile, or create derivative works from the server or client software beyond what is expressly permitted by applicable law or the open-source license.
 
5. User-Generated Content (UGC)
 
You are responsible for any content you post, upload, or transmit on our Service (e.g., in-game chat, character names, guild names). You grant us a royalty-free, worldwide license to use, modify, reproduce, and distribute your UGC in connection with the Service. We reserve the right to remove any content that we deem violates these Terms.
 
6. Disclaimers and Limitation of Liability
 
  • "As Is" Basis: The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free.
  • Limitation of Liability: To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content.
  • Indemnification: You agree to indemnify, defend, and hold harmless the Server, its administrators, contributors, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use or misuse of the Service or your breach of these Terms.
7. Changes to Terms
 
We reserve the right to modify these Terms at any time. We will provide notice of material changes, and your continued use of the Service means you accept the changes.
 
8. Governing Law & Dispute Resolution
 
These Terms shall be governed by the laws of the United States of America. Any disputes will be resolved through amicable negotiation, mediation, or arbitration as determined by the server administrators.
